Modification of the Real Estate Lease Agreement

Termination of Real Estate Lease Agreement

When the lease expires then the tenant must return the lease to the landlord in the same condition as he received it and if it is established that the bills have been paid and there are no damages to the property, the tenant receives the guarantee he had given at the beginning of the lease, signing the relevant acceptance – delivery protocol.

Cases where the tenant fails to deliver the lease on time are dealt with by legal action against him and depending on the delay the court may award the landlord appropriate compensation for the unlawful deprivation of the landlord’s property.

The return of the lease after an indefinite lease is a special case where the lessor must notify the lessee at specific intervals as required by law.

Court order for payment and return of rent – eviction

In cases where a tenant fails to pay the agreed rent, the law has provided for the protection of the landlord through the procedure of an order for payment and return of rent (or eviction). This order includes two orders, a) the payment order and b) order of returning the rent. This is a relatively short judicial procedure in which the court makes an order for payment of rent and eviction of the tenant from the tenancy. After the tenant has been served with the court order, the tenant has 20 days to surrender the tenancy, otherwise once the 20-day period has elapsed, the landlord can enforce the court order by special order to the bailiff, who forcibly evicts the tenant or anyone else in the tenancy, in the presence of a police officer, changes the locks and seals the tenancy. Under the payment order, he may seize movable and immovable property until full and complete payment of the outstanding amount.
